Q. Why did I close my loan with a broker or bank but another company has my loan now? There a two main situations that make this happen. First, You may originated your home loan with a broker but the loan was underwritten and funded by another bank or mortgage lender. So there is an appearance that the loan was sold, but it never was actually sold. It was written by one company but secured and then serviced by another. This is very common. The mortgage bank may have also funded the loan on its own. This means that the mortgage bank originated and funded the loan with their own capital. The loan was probably already guaranteed to another servicer's that agreed to buy the loan within 30/60/90 days after it was close. This means that the funds, although they come from the origination bank, are guaranteed to the originating bank by the other mortgage company. So the originating bank followed the underwriting guidelines of the final servicer.
The second way this may occur is that the loan was actually sold by the originating servicer. The original loan was funded by the same company that wrote the application. In order to regain capital, to lend out to more applicants, the mortgage servicer needs to free up some asset. They do so by either going to the open pools of money on the market. Or resell the whole loan and servicing to another lender. This may happen several times during the life of the mortgage but the original terms agreed to by the lender and borrower will never change. In the same line is that the lender may sell or outs source the servicing of the loan to a third party. The third party may be another lending company. The loan is still owned by the original mortgage company it is just being serviced by another loan agency. Remember there can be issues involved when loans are sold that are out of you hands.
